Terms & Conditions

These Terms govern your use of the Kahgez platform operated by Lusso Mora (Proprietorship of Himanshu Goel) — operating as Kahgez. By creating an account, browsing, bidding, buying, or selling on Kahgez, you accept and agree to be bound by these Terms.

1. Eligibility

You must be 18 years of age or older and capable of entering into a binding contract under the Indian Contract Act, 1872.

2. Accounts

You are responsible for safeguarding your password and for any activity under your account. Notify us promptly of any unauthorised use.

3. The Marketplace

Kahgez is a curated platform that connects authenticated sellers (ateliers, dealers, estates, artisans) with buyers. We act as a facilitator, not a direct seller, except where explicitly stated. Each object passes a 23-point provenance review before going live, and is sold with a Certificate of Authenticity.

4. Sellers — obligations

• You warrant that you own the object or have the legal right to sell it.
• You confirm the object is not stolen, smuggled, looted, or subject to unresolved cultural-heritage disputes.
• For antiquities older than 100 years, you confirm compliance with the Antiquities and Art Treasures Act, 1972.
• Listings must be honest and complete. Misrepresentation results in delisting and ban.
• Commission rates: 12% (Atelier free), 8% (Curator ₹4,999/month), 5% (Maison ₹14,999/month). Commission applies on net sale value.

5. Buyers — obligations

• You agree to make payments only via the Razorpay gateway integrated with Kahgez. Off-platform payments are not protected.
• Winning an auction creates a binding contract. Failure to pay within 24 hours of close may result in suspension and forfeiture of bidding rights.
• You must accept delivery at the agreed address. Failed deliveries beyond two attempts incur a re-shipping fee.

6. Auctions

Each auction has a starting bid, an optional reserve, and a fixed end time. Bids are atomic and irrevocable. The highest bid above reserve at auction close wins. We reserve the right to extend the close by 2 minutes if a bid is placed in the final 60 seconds (anti-snipe protection).

7. Pricing & Taxes

Prices are in INR and inclusive of GST where applicable. Customs and duties for international shipments are the buyer’s responsibility unless DDP shipping is selected at checkout.

8. Intellectual Property

All editorial content, photography, copy, and curatorial notes on Kahgez are © Lusso Mora. The Kahgez wordmark and the Lusso Mora label are pending trademark registration. You may not reproduce them without written permission.

9. Prohibited Items

• Religious idols and ritual objects taken from places of worship.
• Ivory, rhino horn, tortoise-shell, or other CITES-restricted materials.
• Objects subject to ASI registration without proper documentation.
• Counterfeits or replicas misrepresented as originals.
• Anything illegal under Indian law.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim. We disclaim all implied warranties.

11. Indemnity

You agree to indemnify and hold Kahgez harmless against any claim arising from your breach of these Terms or from objects you list.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Panchkula, Haryana shall have exclusive jurisdiction. Disputes shall first be referred to mediation under the Mediation Act, 2023, before commencing litigation.

13. Termination

We may suspend or terminate your account for violation of these Terms, fraud, or abuse. You may terminate your account at any time by writing to kahgez@gmail.com.
